General Terms and Conditions Ellis Hollering Art

Article 1 - General

  1. These General Terms and Conditions apply to every offer from Ellis Hollering Art (EHA) and to every agreement concluded between EHA and the customer.
  2. Situations that are not regulated in these General Terms and Conditions must be assessed 'in the spirit' of these General Terms and Conditions.
  3. The General Terms and Conditions can be found on the EHA website.
  4. EHA has the right to change these General Terms and Conditions. The amended terms and conditions are immediately effective after publication on the EHA website.


Article 2 - Offer

  1. EHA's offer is without any obligation.
  2. EHA is entitled to change and adapt its offers.
  3. Every offer contains information about price, method of payment and delivery.
  4. Prices of products, services and shipping costs include VAT.


Article 3 - Agreement

  1. The agreement is fully effective at the time of (down) payment by the customer to EHA.
  2. If the customer has accepted the offer, EHA will confirm this.
  3. The agreement is entered into under the conditions of sufficient availability of the products concerned.
  4. EHA is free not to enter into the agreement and to refuse the order or request or to require special conditions to the execution.
  5. EHA provides customers with information on its website information how to make use of the Right of Withdrawal.

Article 4 - Withdrawal

  1. When purchasing, the customer has the option to cancel the agreement without giving any reason during 14 days after receipt of the product.
  2. After receipt the customer will handle the product and its packaging with care. He will only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. In case of withdrawal, he will return the product with accessories in its original condition and packaging to EHA.
  3. In case of withdrawal, the customer must:
    • inform EHA within 14 days of receipt of the product;
    • return the product within 14 days of receipt;
    • send a copy of the proof of shipment to EHA.
  1. If the customer does not meet the conditions of bullet 3 above, the right of withdrawal lapses and the purchase is a fact.
  2. The costs of return are borne by the customer.
  3. If the customer has paid, EHA will refund the customer within 14 days of receipt of the returned product.
  4. If EHA is liable for any damage, the liability is in all cases limited to the invoice amount, or to that fraction of the amount to which the liability relates.


 Article 5 - Conformity and Warranty

  1. EHA strives to ensure that craftwork products meet the specifications stated in the offer.
  2. Deviations of minor significance between the completed work and the original offer do not constitute a reason for rejection, discount, compensation or dissolution of the agreement.
  3. Errors or mistakes in the offer, in the agreements or in the correspondence with EHA are not binding for EHA.
  4. Any defects or incorrectly delivered products must be reported to EHA within 14 days of receipt. The products must be returned in the original packaging and in new condition.
  5. The warranty expires if the:
    • customer has repaired and/or modified the delivered products or has had this carried out by third parties;
    • delivered products have been exposed to abnormal conditions or have been handled carelessly.


Article 6 - Delivery and execution

  1. Delivery times are indicative for products that have to be made on request. Exceeding a delivery term does not entitle the customer to compensation.
  2. If EHA suspects, or knows, that it cannot deliver on time, we will inform the customer.
  3. EHA sends ordered products to the address that the customer has made known to EHA.
  4. The risk of damage or loss of products rests with EHA until the moment of delivery to the customer or transfer to a carrier designated by the customer.


Article 7 – Payment

  1. Unless otherwise agreed, the amounts owed by the customer must be paid within 7 working days after the start of the reflection period as referred to in Article 4 bullet 1.
  2. In the event of non-payment by the customer, EHA has the right, subject to legal restrictions, to charge reasonable costs made, which will be mentioned in advance to the customer.


 Article 8 - Complaints procedure

  1. Complaints about the product or the delivery must be clearly described and fully received by EHA within 14 days of receipt of the product.
  2. Complaints submitted will be answered within 14 days of receipt. If the complaint requires a longer processing time, EHA will give an indication of the lead time within 14 days.
  3. If a complaint is found to be justified by EHA, it will, at its option, replace or repair the delivered products free of charge.


Article 9 - Privacy Policy

  1. When purchasing in the webshop, EHA uses the data (name, address and e-mail address) that you provide to us.
  2. When you visit our web store, EHA automatically receives your IP address and information about your computer.
  3. The EHA web store uses an online e-commerce platform from One.com. Your data is processed by One.com on a secure server.
  4. Protection of your credit card information is carried out via information encryption using a secure-socket-layer technology and stored with an AES-256 encryption.
  5. In EHA web store you can be directed away from our site via web links. EHA is not responsible for your privacy on other sites.
  6. EHA takes appropriate measures to protect your personal data and follows best practices in the industry.


  1. When carrying out a transaction (order, delivery, return, credit card check, etc.) you agree to the use of your data by EHA.
  2. When using your personal data for marketing purposes, EHA will ask for your explicit permission in advance, or offer you the option to refuse it.
  3. You can revoke a previously given permission for the use of your data at any time via the EHA website.
  4. By choosing to use a direct payment gateway to pay for your purchase, you consent to the credit card company using your information solely for that purpose.
  5. If the law obliges us to do so, or if you do not comply with our General Terms and Conditions, you give EHA permission to disclose your personal data.

Article 10 - Disputes

Only Dutch law applies to agreements between EHA and the customer to which these General Terms and Conditions apply. Even if the customer lives abroad.
